How to handle this offer/lease & option period/repairs:

Note: the seller’s, buyer’s agent and listing agent’s emails are included on this email - so when you REPLY TO ALL everyone gets the counter offer at the same time.

 

How to counter offer:

Step# 1 – Sellers, as soon as you receive this email, REPLY TO ALL, as to when you will send a counter offer. Sellers please do this now & send copy of seller disclosure to buyer agent.

Sellers, when you do counter, send it in the body of this email, by replying to all parties.

You do not need to down load the contract and mark up the contract, to make a counter offer, just simply write in this email as to what your counter offer is. Once the contract has been negotiated, then download the contract and make the changes.

Step# 2 – Buyer’s agent will present your counter offer to their client and deliver a counter offer back in this same fashion by giving your counter offer in this email.

Agents, be sure to REPLY TO ALL.

Step# 3 – Sellers, once all terms have been accepted, please make all changes and be sure to initial by each change, initial at the bottom of each page, sign and date/execute the offer. Send copy of contract and seller’s disclosure to both listing agent and buyer’s agent.

 

Buyer's agent normally sends a copy of the contract to the title company, with the earnest money.

Agents, send option check directly to seller.

Negotiation of repairs (if any), during option period, is handled same way as negotiating the

** Sellers, if you have any questions on the contract, DO NOT CONTACT THE BUYER’S AGENT. Please contact us, we will answer any questions. Contracts do not need to be signed on weekends, so do not feel rushed.

Texas State Law does not allow the buyer’s agent to negotiate (directly or indirectly) with the seller. We will answer any questions regarding the offer. These emails are only delivery of offers and counter offers, contract. We recommend negotiating a dollar amount in lieu of doing the repairs.with the listing agent, buyer’s agent and seller all present via email
